It’s being promoted on the official government website of the Republican-controlled Ohio Senate. Republican Senate President Matt Huffman shied away from labeling “On the Record” a news service when questioned by reporters shortly after its launch. As of Friday, the blog was the only link available under the “News” tab for the Ohio Senate. In comparison, the website for the Republican-led Ohio House features press releases on its signature bills, and awards and activities related to both Republican and Democratic lawmakers. The blog they spearhead is maintained by Legislative Information Services, an IT office for both of Ohio's legislative chambers with a $13 million annual budget.

The bill has since been misinterpreted due to language surrounding the phrase “perinatal death” in one of its sections (here). Perinatal death, by one of three definitions by the American Academy of Pediatrics published in May 2016, is the fetal death starting at gestation of 20 weeks and ending at infant death up to 28 days of age (see “Definitions” section on “perinatal death”) (here). BILL AMENDEDThe bill’s language on “perinatal death” was amended twice in assembly before reaching the state senate (see different versions of the bill) (here). BILL DOES NOT DECRIMINALIZE INFANTICIDELaw professors on reproductive health consulted by Reuters said the bill does not decriminalize infanticide and the amendment sought to limit misinterpretation of its language. A California reproductive health bill does not legalize infanticide or killing babies up to 28 days old.

“Comstock is really the backdoor way to remove access to abortion across the whole country,” said Greer Donley, a University of Pittsburgh Law School professor who specializes in abortion law. Severino argued that, at least when it comes to the Comstock Act’s prohibitions on mailing abortion pills, Congress is well within its powers to regulate those shipments. Several towns, some in New Mexico and elsewhere, have passed local ordinances that cite the Comstock Act and prohibit business within those jurisdictions from shipping or receiving items used for abortions in the mail, as covered by the Comstock Act. The lawsuits in New Mexico state court that those ordinances have prompted may provide for another opportunity for courts to elaborate on what the Comstock Act means. The Supreme Court, in the emergency order it issued last week, did not say anything about the Comstock Act.
